
The National Environmental Licensing Authority (hereinafter “ANLA”) has updated its fee structure for environmental services with a sector-specific approach.
ANLA issued Resolution No. 0921 of May 14, 2025, through which it adopts a new fee framework for charges related to the evaluation and follow-up services of licenses, permits, concessions, authorizations, and other environmental management instruments. This resolution not only fully replaces Resolution No. 1140 of 2022 (amended by Resolution No. 0999 of 2023), but also introduces significant conceptual and operational changes.
One of the main changes is the adoption of the Basic Value Unit (UVB by its acronym in Spanish) as the reference for determining fees, in compliance with Articles 313 and 372 of the National Development Plan 2022–2026 (Law 2294 of 2023). This means that values previously expressed in minimum wages or Tax Value Units (UVT by its acronym in Spanish) are now transitioned to a new system.
The regulation establishes a more detailed system for calculating the service fee, which includes:
- Technical staff fees (man/month) according to category.
- Travel expenses (land and air).
- Laboratory costs or additional studies.
- A component of administrative expenses (25%) on the accumulated subtotal.
Also, specific cases are regulated, such as:
- Minor modifications or normal adjustments within the ordinary course of licensed projects.
- New services, such as monitoring corrective measures in sanctioning procedures (Law 1333 of 2009, amended by Law 2387 of 2024), which also incur charges.
- Partial reimbursement in case of procedures incorrectly assigned on the VITAL platform, with a deduction of 5 UVB for administrative management.
In the sectoral field, the tariff tables were updated and expanded for projects in energy (including plants with alternative sources more than or equal to 50 MW), hydrocarbons, mining, infrastructure, and post-consumption management.
A subsequent recalculation is also contemplated when the number of professionals or the duration of the service was not initially foreseen, which must be charged through a final administrative act. Additionally, the fee for technical visits will no longer be collected in advance, but at the end of their completion.
