ANI ends the suspension of several obligations and proceedings

ANI had been gradually reactivating its contracts, from the inclusion of transport infrastructure works as exception to the preemptive mandatory isolation measure through Decree 531 of 2020.

Thus, notwithstanding that ANI ordered the suspension of 21 administrative proceedings and several contractual obligations through Resolution No. 471 of 2020, through Resolution No. 4985 of 2020 ANI ordered the progressive reactivation of its concessions through the works reactivation plan, meanwhile, some administrative actions and contractual obligations remained suspended.

Given the progressive reactivation of the transport infrastructure works, a total of 43 road infrastructure project have been reactivated complying with biosafety protocols. Consequently, it is estimated that a total of 43,505 jobs have been reactivated in the projects that are under ANI’s charge.

This led ANI to issue Resolution No. 6185 of 2020, in which ANI reminded that the Ministry of Health and Social Protection adopted biosafety protocols for minimizing the risks of COVID-19 transmission and, that through Resolution 679 of 2020, that same Ministry adopted the biosafety protocol for the transport infrastructure sector.

Consequently, considering that (i) the National Government extended the preemptive mandatory isolation measure until July 1st, 2020 through Decree 749 of 2020 (maintaining as exceptions those related to the transport infrastructure sector)and that (ii) through Decree 768 of 2020 the National Government reactivated toll collection to all vehicles circulating in the national territory; ANI considered that the factual and legal conditions are given to allow the full development and performance of its projects following the rules set forth in the respective contracts. 

In this context, ANI only maintained the suspension for the following administrative activities: (i) revision and evaluation of private initiatives PPP projects (Law 1508 of 2012); (ii) contract’s certifications requests; (iii) procedures for port and pier concession request, contractual amendments and permissions in port matters that require public hearings.

Moreover, ANI revoked Resolutions Nos. 471 and 4985 of 2020, which ordered the suspension of several obligations and proceedings. Therefore, as from this Resolution No. 6185 of 2020, the performance and development of all the road, airport, port and rail projects are returning to normality in accordance with their respective contracts.
